CADVIBE Construction Plans    Terms and Conditions

These Terms and Conditions ("Terms") govern the use of services provided by CADVIBE LLC ("CADVIBE") in relation to the creation and delivery of conceptual construction plans. Please read these Terms carefully before using our services. By using our services, you agree to and commit to comply with these Terms. If you do not agree with these Terms, do not use our services.

Nature of Services

CADVIBE specializes in creating conceptual drawings based on our clients' preferences. We are not licensed architects or engineers. The construction plans we create are conceptual and are not intended for use in construction without the proper supervision and approval of a licensed professional, such as an architect or engineer.

Client Responsibility

By using our services, the client acknowledges and understands that:

a) It is the sole responsibility of the client and the contractor to ensure that the construction plans created by CADVIBE comply with all relevant national, state, and local building codes, as well as any other applicable laws or regulations.

b) The client and the contractor are responsible for obtaining all necessary permits and coordinating all required inspections by local governmental authorities before commencing any construction based on the conceptual plans provided by CADVIBE.

c) Before commencing construction, the client and the contractor must review the plans to ensure the accuracy of dimensions and details, adjusting them to local conditions if necessary.

d) The final selection of construction materials, such as masonry, lumber, structural beams, construction panels, roofing, etc., which may affect dimensions and details, is the responsibility of the client and the contractor. CADVIBE is not responsible for material selection decisions.

e) The client and the contractor must adhere to standard construction practices to ensure a weather-resistant and structurally sound final product.

f) All aspects of construction, including methodologies, techniques, work sequencing, safety measures, and the well-being of individuals at the construction site, are the responsibility of the client and the contractor.

g) The quality and freshness of all materials, equipment, and components used in construction are the responsibility of the client and the contractor.

h) It is the responsibility of the client and the contractor to ensure that all manufactured items, materials, and equipment are used in accordance with manufacturer instructions, including any implied warranties or guarantees. The client and the contractor must ensure that all materials, equipment, and components are new and of satisfactory quality.

Release of Liability

By using our services, the client releases CADVIBE LLC and its designers from any liability and damages to third parties related to the use of the construction plans created by CADVIBE.

CADVIBE is not responsible for any actions, omissions, or failures on the part of the client or the contractor in connection with the provided conceptual plans.

Contractor's Obligations

By accepting these Terms, the client acknowledges and agrees that the contractor has the following obligations:

a) Ensure that all tasks comply with national, state, and local building codes and other applicable laws.

b) Obtain the necessary permits and coordinate inspections with local authorities.

c) Review the plans before construction begins to ensure the accuracy of dimensions and details.

d) Collaborate with the client on the final selection of construction materials.

e) Follow standard construction practices to ensure a quality final product.

f) Be responsible for all construction methodologies, techniques, and safety measures at the construction site.

g) Ensure the quality of materials, equipment, and components used.

h) Follow manufacturer instructions to ensure proper use of materials, equipment, and components.

These Terms and Conditions constitute a legally binding agreement between the client and CADVIBE LLC. If you do not agree with these terms, we recommend that you do not use our services.

CADVIBE Website Creation Terms and Conditions

Introduction
The following Terms and Conditions govern the creation of websites by CADVIBE for clients.
By using our services, you accept the following terms and conditions. We recommend that you carefully read these terms before using our services. CADVIBE reserves the right to modify these terms at any time without prior notice.

CADVIBE's Liability and Release Creation and Delivery: CADVIBE commits to creating and delivering the website according to the client's agreed-upon requirements. Once the website has been delivered and approved by the client, CADVIBE is released from any responsibility or obligation related to it.

Post-Delivery Use: CADVIBE will not be responsible for technical issues, updates, maintenance, or any other matters related to the website after its delivery and approval by the client.

Content and Copyright: The client is responsible for providing the necessary content and copyrights for the website's creation. CADVIBE is not responsible for the content that has been placed on the website and assumes no liability for any violations of copyright or intellectual property rights related to such content.

Client Responsibilities Content and Copyright: The client guarantees that they have the necessary rights to the content provided to CADVIBE and that said content does not infringe upon the rights of third parties.

Updates and Maintenance: After the website's delivery, the client is responsible for any updates, maintenance, and resolution of technical issues. CADVIBE is not responsible for these tasks.

Texas Liability Release: To the maximum extent permitted by law, the client releases CADVIBE from any liability, claims, damages, or demands related to the website created by CADVIBE, in accordance with the laws of the state of Texas.

Upon issuance of the corresponding invoice and payment by the client, it shall be considered that the deal has been effectively concluded. This implies that the client accepts the work performed by CADVIBE and acknowledges that the website has been delivered in accordance with the agreed-upon requirements, even if a formal delivery document has not been signed.

This provision ensures that, once the payment transaction has been completed, both parties understand that the project is deemed completed, and CADVIBE has no further obligations regarding the specific website.

Acceptance of Terms and Conditions By using CADVIBE's services for the creation of a website with a one-time payment, the client accepts these Terms and Conditions in their entirety. If you do not agree with these terms, we recommend that you do not use our website creation services.

CADVIBE is committed to providing high-quality services and meeting client expectations to the best of our ability. However, it is essential to understand the responsibilities and limitations set forth in these terms and conditions before proceeding with website creation.
