CADVIBE, LLC Terms and Conditions
These Terms and Conditions (“Terms”) apply to services provided by CADVIBE, LLC (“CADVIBE,” “we,” “our,” or “us”). By requesting, approving, purchasing, or using our services, the client agrees to these Terms.
1. Nature of Services
CADVIBE provides design plans, drafting services, custom floor plans, house plans, residential design plans, small commercial design plans, 3D renderings, drafting support, and blueprint printing.
CADVIBE is not an architecture firm or engineering firm. We do not provide licensed architecture or engineering services unless such services are separately coordinated through properly licensed professionals when required.
Plans, drawings, renderings, and related documents provided by CADVIBE are prepared based on information provided by the client and are intended for design, planning, coordination, visualization, pricing, and project development purposes.
2. Client Responsibility
The client is responsible for providing complete and accurate project information, including measurements, site conditions, sketches, photos, existing plans, requirements, preferences, and any information needed to complete the requested work.
The client is responsible for reviewing all plans, drawings, dimensions, notes, details, and project information before using them for pricing, permitting, ordering materials, or construction.
The client and/or contractor are responsible for verifying all dimensions, site conditions, structural requirements, code requirements, utility locations, materials, and construction methods before work begins.
3. Permits, Codes, and Approvals
The client and/or contractor are responsible for determining whether permits, inspections, licensed architecture, engineering, surveys, site plans, energy reports, structural calculations, or other professional services are required by local, state, or federal authorities.
The client and/or contractor are responsible for submitting plans to the appropriate authorities and obtaining all required permits, approvals, inspections, and clearances before construction begins.
CADVIBE does not guarantee that any plan, drawing, rendering, or document will be approved by a city, county, homeowners association, lender, builder, contractor, inspector, or other reviewing party.
4. Licensed Professionals
If a project requires licensed architecture, engineering, surveying, energy compliance, or other professional services, those services must be provided by the appropriate licensed professional.
If CADVIBE helps coordinate services from licensed professionals, the client understands that those professionals are independent parties. CADVIBE is not responsible for their reports, calculations, decisions, timelines, comments, requirements, fees, or approvals.
Any fees for licensed professionals, consultants, reports, stamps, calculations, or additional requirements are separate from CADVIBE’s standard drafting and design fees unless clearly stated in writing.
5. Contractor Responsibility
The contractor is responsible for construction means, methods, techniques, sequencing, site safety, workmanship, materials, equipment, code compliance, inspections, and final construction quality.
The contractor must review all plans and verify all dimensions, details, materials, and site conditions before beginning construction.
The contractor is responsible for following manufacturer instructions, standard construction practices, safety requirements, and all applicable laws, codes, and regulations.
6. Revisions and Changes
CADVIBE may include a specific number of revisions depending on the project agreement, quote, or invoice. Revisions must be requested clearly and in writing.
Changes requested after approval, after major drafting work has been completed, or outside the original project scope may require additional fees.
Examples of additional-scope work may include major layout changes, added square footage, new design direction, additional renderings, new elevations, engineering-related changes, city comments, contractor-requested changes, or revisions caused by incomplete or incorrect information provided by the client.
7. Timeline and Delivery
Project timelines depend on project size, complexity, client response time, required information, revision requests, workload, and any third-party services involved.
Estimated timelines are not guaranteed unless specifically agreed to in writing. Delays caused by missing information, late responses, changes in scope, third-party consultants, city comments, or client revisions may extend the delivery date.
8. Payments, Deposits, and Balances
Payment terms will be listed in the project quote, invoice, or written agreement.
Deposits, partial payments, and payments for work already completed are generally non-refundable.
CADVIBE may pause work, delay delivery, or withhold final files if payments are not made according to the agreed payment terms.
Final files may not be released until the outstanding balance is paid in full.
9. Cancellations
If the client cancels a project after work has started, the client is responsible for payment for all work completed up to the cancellation date.
Deposits and payments for completed work are non-refundable.
If third-party services have been requested or coordinated, those fees may still be due even if the project is cancelled or not completed.
10. Blueprint Printing
CADVIBE offers blueprint printing up to 24 x 36.
The client is responsible for reviewing files before printing. CADVIBE is not responsible for printing errors caused by incorrect files, outdated plans, wrong scale, low-resolution files, missing pages, or client-provided file mistakes.
Printing fees are separate from design and drafting fees unless clearly included in the quote or invoice.
11. 3D Renderings
3D renderings are visual tools used to help communicate design ideas. Renderings may include approximate colors, materials, lighting, furnishings, landscaping, fixtures, or finishes.
Actual construction, materials, colors, dimensions, and finishes may vary from the rendering. Renderings should not be used as construction documents.
12. Ownership and Use of Files
CADVIBE retains ownership of its original working files, templates, CAD files, models, and design/drafting processes unless otherwise agreed in writing.
The client receives the right to use the final delivered documents for the specific project for which they were created after full payment is received.
CADVIBE is not required to release editable CAD files, source files, or 3D model files unless this is specifically included in the quote or agreed to in writing.
13. Portfolio and Marketing Use
Unless the client requests otherwise in writing, CADVIBE may use project images, drawings, renderings, photos, videos, or general project information for portfolio, website, social media, advertising, and marketing purposes.
CADVIBE will avoid sharing private personal information such as the client’s full address, phone number, email, or sensitive project details without permission.
14. Limitation of Liability
CADVIBE is not responsible for construction defects, job site conditions, contractor errors, material failures, code violations, permit issues, inspection failures, structural failures, delays, cost overruns, or damages resulting from the use, misuse, modification, or interpretation of plans, drawings, renderings, or documents.
The client agrees to release and hold harmless CADVIBE, LLC, its owners, designers, contractors, and representatives from claims, damages, losses, expenses, or liabilities related to construction, permitting, inspections, contractor work, third-party services, or use of CADVIBE documents beyond the scope of our services.
15. Acceptance of Terms
By requesting, approving, purchasing, paying for, or using CADVIBE services, the client confirms that they have read, understood, and agreed to these Terms and Conditions.
If the client does not agree with these Terms, they should not use CADVIBE services.
